General Terms

All of the made to order sofas and armchairs Auburn Fox Limited offer for sale are handmade to order in either the United Kingdom or Italy. It is important that you understand that by placing an order you are entering into a legally binding contract to complete your purchase. All payments made to us for made to order products are non-refundable including any deposits.

Once an order has been placed and a minimum deposit of 50% has been paid, we will instruct the manufacturer to create your sofa/armchair. We are unable to accept cancellations or amendments after this time. Your deposit is non-refundable as our manufacturers will have already been paid up front by us to commence work on your order.

Leather is a natural product, it is important that you are aware that the texture and shade of the leather colour can vary between batches as each hide will absorb the dyes differently.

By placing an order and signing these terms and conditions, you acknowledge and understand that although we do our best to match the colours where applicable, we can not guarantee an exact match and colours may vary. Some leather will include natural imperfections such as mottling, scarring and other imperfections to the hide that were caused during the animals lifetime. Variations in leather for any of the reasons above are not considered as a fault and are natural characteristics of a leather product.

 

Delivery

Once we’ve received your order at our distribution warehouse we will inform you and attempt to arrange a convenient date within 7-10 days. Your order will not be delivered until the full remaining balance has been cleared. Our delivery partners can only hold your sofa for a maximum of 10 days before an additional storage fee will be levied on a per day basis. It is your responsibility to ensure that the final balance is cleared in full and that there is adequate time to arrange delivery within a maximum of 10 days of being notified that your order is ready.

Deliveries are completed by one of our third party delivery partners. Auburn Fox Limited are not liable for any delay caused by a third party delivery service.

Auburn Fox Limited are not responsible for any consequential loss incurred by you when taking a delivery. This includes loss of earnings, loss due to an alternative purchase, loss of annual leave, loss of time, inconvenience or any other loss incurred when taking delivery of your order.

Deliveries will be made to a room of your choice. If you require delivery to another floor which will involve the use of a staircase you must inform us at the time of placing the order, there may be an additional charge if this is the case.

It is your responsibility to ensure that your new furniture will fit into its intended room. Auburn Fox Limited are not liable for any loss incurred if alterations are needed to your property to allow access for delivery. Please inform us if there are any restrictions at your property including parking restrictions. Please ensure that on the day of delivery there is easy access for us to deliver your order.

We will return your order to our distribution warehouse if there are access problems at the delivery address; there is no one over the age of 18 to take delivery; the product doesn’t fit in the intended room; if providing delivery is unsafe or unlawful. You will have to pay a redelivery charge if redelivery of your order is needed for any of the reasons stated above. You may also incur an additional storage charge if temporarily returning the order requires our delivery partners to store your order for longer than 10 days after it was initially received.

At the time of placing your order you will be advised approximately how long it will take to fulfil your order. This is an estimate only based on the information we have from the manufacturer at that time. Auburn Fox Limited are not responsible for delays in manufacturing, deliveries or any other delay outside of our control. If we’re made aware of any delay or if your order arrives earlier than expected we will make every effort to inform you as soon as possible.

We do not recommend you remove your old furniture until we have confirmed that your order is ready for delivery. In the event of a delay, we do not accept any liability for old furniture being removed prior to delivery being made. We are unable to remove your old furniture for you.

Should you wish to return the goods after delivery we will only accept returns where the item is faulty and cannot be repaired. If you believe there is a fault with your order please contact us at the first opportunity

Your Consumer Rights

  1. If a product is found to be faulty or damaged at the time of delivery please report this to the delivery team. The delivery team will endeavour to contact us to report the issue and receive further instruction. The delivery team may need to photograph any fault or damage found. You will have the following options in this circumstance:
  • We will arrange for a technician to visit and repair the product. If a repair is not possible then we will arrange to replace the product.
  • If the repair has been poorly carried out, takes an unreasonable amount or causes significant inconvenience you may request that the item be replaced.
  • If the repair or replacement is still not suitable then you may request a discount on the item, an exchange or a refund.
  1. If a fault or damage is discovered after the time of delivery up to 30 days from the delivery date please report it to us as soon as possible. We will require a photograph of any damage/fault. We will send a technician to repair the damage/fault. If the damage/fault cannot be repaired then we will arrange to replace the product. In the event of a replacement we will be required to remove the damaged/faulty product so it can be returned.
  1. If a fault or damage is discovered after 30 days up to 6 months from when the product was delivered please report it to us as soon as possible. We will require a photograph of the damage/fault and we may require the product to be inspected to see if the damage/fault was likely present at the time of delivery. If it is deemed that the damage/fault was present at the time of delivery then we will arrange for a repair to be made. If the product cannot be repaired then we will arrange for it to be replaced.
  1. Where damage/faults are discovered after 6 months of receiving the product you will have to provide evidence that the damage/fault was present at the time of delivery and not caused by reasonable wear and tear.
  1. If you haven’t purchased one of our Staingard plans then Auburn Fox Limited cannot accept any liability for accidental damage, spills or staining after your items have been delivered.
  1. Cooling off period. The cooling off period does not apply to goods purchased in store. Where an item has been purchased online, by email or telephone and you have not seen the product prior to placing an order, you have the right to cancel your order up to 14 days after receiving delivery. You will be required to arrange for the product to be returned to our warehouse in its original condition and packaged to prevent any damage in transit. We reserve the right to reduce the amount of money refunded where the item is reduced in value as a result of it being mishandled or damaged by you or anyone returning the item on your behalf.. This clause does not include bespoke items that have been custom made to your specification, where the item has been damaged during self assembly or where the product was purchased in store.
  1. Cancelling under the cooling off period. If you wish to cancel your order and the cooling off period applies then you must inform us in writing no later than 14 days after your delivery date. You must take care of the product(s) while they are in your possession. You must not use the product or handle the product anymore than necessary in order to return it.
  1. When cancelling under the cooling off period we understand that most people do not have the means to return larger items. At your request we may be able to arrange collection for you. In this instance you will be charged for any expense we incur by arranging and facilitating the collection of your item(s). We will deduct this from any refund amount you receive.
  1. If you cancel the contract and Auburn Fox Limited are not at fault or if there is no statutory right to do so then any refund received will be at our discretion and will not include any deposit paid and will have any of our additional costs deducted from it.
